Are you sure it was a male? I see no crest or silver in its tail. Looks female to me

I third that, they all look female to me - the "male" has no silver flash in the tail and even though the crest would be flat to the skin because it is out of the water you should still be able to make out the fold.

I think he/she they said the newts were in his/her pond, in which case provided he/she doesn't disturb them or their habitat then there is no harm in taking photographs.

there were a load of these in the pond at my primary school...and some grass snakes...havn't seen any since though...not very many around
