Default Owed money - next step?

Okay - so a certain Scottish member of this forum who was supposed to be selling up due to personal problems some time ago has owed me money for a crested gecko for over a year now.

I have asked God knows how many times that this be paid, had even arranged a swap for royals instead of the cash when she said she was selling up and STILL haven't received anything. I have had promises and promises of will pay you, am visiting family in Liverpool so will bring it blah blah

So, what would YOU do next? I have contacted the said member who was online last on 29th Feb and told her I will be eiather seeing a solicitor to go through small claims court to get my cash back or passing the debt over to my husband's businesses debt people.

From what I know, this member messed a fair few people around on her last "I am selling up" and i know that the crested gecko in question that she had off me has since died so I can't ask for him back.

Anyone care to offer advice at all?

(BTW I am happy to name this person via PM or email so that others don't end up being robbed like I have cos that is really what it is - she had goods off me and never paid for them!)

If the animal has died and she gets something offical to say it was sick before she got it then you're on an uphill struggle.

You can issue proceddings in the small claims court without a solicitor just go fill the form in, pay your money and wait for a response via the court from person concerned. Depending on that as to courts actions.

The animal was in excellent health when it left me and I have proof to say that she had spoken to me about him on several occasions when she got him saying how healthy and such he was.

I know the court procedures well as I work the paper claims and such for my husband's company should I need to but am a little unsure how to deal with a cyber contract as such.

Its just the same

As long as you have copies of emails etc that show there was an agreement between you that has not been kept to and that you have lost out as a result (which you have) then thats enough.

TBH, you will prob never need to prove it anyway, unless she contests it in court.

I took action against a certain female up near newcastle who done me, she now has a ccj against her and i am just waiting to send the warrent of execution !.

Makes no difference be it cyber or otherwise on the contract front - she's had goods which weren't paid for only time it gets interesting shall we say is over the distance selling stuff but thats not an issue in this case.

As long as you've got evidence to show the animal was 'fit for purpose' as they say then her claims of anything otherwise will fall on deaf ears. I always have my pups vet checked the day before they leave for this very reason it amazes me what sort of madness folk get upto to try and avoid payment sometimes.

Good luck - another one I've found works well in the past is a postcard to their address with the debt clearly showing, folk seem to get well upset and pay up on that one.

?Because I trusted her - more fool me!

This member I would have classed as a mate at the time and I have had dealings with her in the past with no problems at all as I am sure many other people have.

Just such a shame that she gives so little attention to paying her debts
