yeah thats basically what i was told from consumer direct, you have to send the letter. I did send one, I am posting all my stuff to trading standards today.

I think you have to send the letter before they can take action.
Just send it and add on the cost of recorded delivery to the money you want back from him, I will be.

I live several hundred miles away!

Trading standards will have copies of all emails/recorded delivery letter in a few days.

So will have to see what happens next.

Trading Standards called today, they have passed the details to Plymouth Trading Standards (where he lives), so now just to wait to hear from them.

Plymouth Trading Standards paid him a visit today, and he told them that he has ceased trading and that he had already refunded my money by cheque, which he hasn't.

They are sending him a letter telling him to refund the money within 14 days, after that all I can do is go to the small claims court.

bumping this one up again....

we still haven't got our money back.

He put £22 in my account, and still owes us £198.


Looking at going through small claims court, but can't find his address any more, as I can't find his website! and after looking at previous posts, I would guess it's been removed.

His website was taken down after trading standards appeared at his door, I will PM you his address.

I am going through small claims court also, been busy with uni but hoping to get in touch with them next week.

his website was still open but his email accounts were disabled when i was having my own trouble with him (start of the year)

i seeked legal advice and they took over, and i got my money back. i think i still have his home address and number somewhere. i'll have a look later on today and pm who ever wants it.

thought this would be long sorted out by now, really hope you all get your money of this fool

They can't make him pay up, so small claims court is my only option.

So, Mr Clements has now been served with a summons and has until the 17th of September to pay me the money that he owes me, that is the £82 deposit I paid him on 5th December '07, the interest on that (about 7%), the money I paid for sending recorded delivery post to him and the Small Claims Court fees (£44).
And I will not be accepting any less than the full amount, he had his chance to refund the deposit and he never took it.

If he does not respond or refuses to pay then it will cost me another £20 odd to take him to court, and he will need to drive several hundred miles from Plymouth to Central Scotland to defend himself.

I wonder what he'll choose to do.
