Clio - it doesn't matter it's only £10. What he is doing is 'deception by goods' which is a criminal offence. He is taking your money claiming it is for his services, and he does not have the means to offer these services. That is on top of breach of contract, breach of sales of goods act, breach of distance selling act, and more!
I've got the next two weeks off work (paternity leave!) so I have plenty time to spend on this. I think him owing you, Rob, the other people who have contacted me and wish to remain out of public view (but have consented to me passing their details to the courts and the police, thankfully) and my wife is just the tip of the iceberg. I have already unearthed a lot more on him, some of which relating to illegal activities to do with computers/software, which I will spend the time gathering evidence about if the money doesn't show as I'm sure the Police would be happy to know about everything I find. I'm not going to let this go to sleep until she has all her money back as I am absolutely livid about the whole thing. I could have shrugged it off if it was just me, but to do this a 9 month pregnant woman is simply disgusting, and I would have thought he would be more understanding as he has claimed on this forum he lost his son. |

Simon, I'm pleased you got your money back. If you are willing, would you PM the details to me as I will add them to the court papers/report to police. I'm convinced the scope of this guys dealings extends far beyond just this forum and until my wife gets her money back I'm determined to expose him for what he is. Unfortunately for him I don't think he was betting on crossing someone who is legally qualified and quite nifty with the Internet! I've unearthed so much stuff on him it's unreal. It's all going to be passed to the police once I get it all in order. Needless to say I'll be up all night tonight pursuing this. I've also touched base with some contacts (friends of friends of friends) at his local newspapers and one journo in particular is very very keen to run with the story. I'm getting a constant feed of messages from people whom he owes money to so there's stacks of weight in the story.

Andy bought 2 ipod shuffles off me from his username BCI, he was being super paranoid that they were 100% real etc, on about he had been sold fake ones before and was taking them to court etc, after paying he was asking about screens on them/more pictures (so he obviously didnt know anything about them!) He paid via paypal and I sent them recorded delivery. I got the feeling he could be the kinda person to change his mind and try to reclaim his payment so i put the tracking details into paypal etc. I never heard from him about recieving them then saw he got them and readvertised them on here for £25 less than he had paid me the day they arrived to him? Im suprised to read what hes done but i suppose what seemed insecure trust issues about buying online were infact a reflection of what he does to other people. I hope you get your money back & congratulations on the soon to be new addition to your family

Thanks for the message James. Can you confirm the address you sent the iPods to matches the ones listed on his aforementioned website? I've had the court summons sent to both addresses on there.
I've just got off the phone to one of the lads from the legal team at my work and he's offered to take on the case for me which I'm over the moon about! He's good friends with both me and my wife and he is outraged that Andy has caused her so much stress so he's going to pull out all the stops and pursue him for damages. The £70 he owed her originally has now gone up to £95 + 8% daily interest (court costs) and that's before I even start the secondary court case for damages. I'm going to let them go to town on this guy as it's not going to cost me a penny! The money he is going to have to pay the court to be sent to me is going to go up and up though. |

Wow, you must really have some influence cos when someone scammed me, I took legal advice and was told it would cost me £40 to take my case to small claims court. If I won and the seller didn't pay up, I would then have to go back to court again and pay another £40 to get them to enforce a payment arrangement. If the seller was on benefits, they could allow him to pay me as little as £1 per month. If the seller moved address (and he did), it was going make things a lot more difficult aswell. I took it all the way through trading standards aswell. I was told in reality it would cost me more time and money than it was worth and I was owed over £200!!
