Andy Plumpton - Cheshire Geckos and Vivs - Please read

Hello everyone. I was hoping for some help from the members of this forum. Apologies if it is in the wrong section, but this seemed the best place.

I have just returned from a business trip and discovered my wife has given Andy Plumpton £170 of her money for a vivarium that is yet to materialise (and I am casting doubts to it's existence.)

I am absolutely fuming. I have just sat and read through a plethora of text messages between my wife (who is 1 week off having a baby I must add - so stress at this time could put my babies, and her, well being in danger) and Andy Plumpton aka Cheshire Geckos and Vivs aka Crewe Reptiles aka BCI aka plumpton1887 aka vivbuilder (all of which have been banned from this forum.) He promised her a vivarium over a week ago and from what I have read there has been excuse after excuse after excuse as to why it hasn't been delivered. I was absolutely horrified to find out that he promised her delivery, by a 'mate' of this supposed viv last week and she waited up until 1am.

The list of excuses:

First: Courier wouldn't take it because it was too large. I find this difficult to fathom because having used couriers for the last 10 years I have not found a single one who will let you book without measurements. Why would they risk sending a van for something too big? They make sure it's suitable before you book.

Second: The courier delivered to the wrong address. My wife contacted TNT and they had nothing on their system whatsoever for her. I have also contacted them myself and had them check and double check, and no collection from Andy Plumpton for delivery to my wife exists, or ever has.

Third: The viv is in his mates van. He doesn't answer his phone. His business partner doesn't answer his phone. So how did it miraculously get from his mates van to a TNT truck on Monday to supposedly be sent to us if Andy can't contact him?

He has given her back £100 via paypal but still owes her £70 and now has had the cheek to try and take £20 from her as a 'cancellation fee'! It seems very clear this vivarium doesn't exist as he told her it had been built in less than a day, which while I accept is possible, it seems highly unlikely considering reputable companies state 5-14 days for build and completion. It seems far more likely to me that he took her money, and is stalling for time while he tries to source a viv matching her requirements.

The reason I am writing this thread is to urge people to contact me if they have any further information about him or have been victim of a similar situation as, if Andy doesn't refund the full amount back to my wife that is owed in the timescale she has asked (tonight I believe), I am compiling a case against him, both to present to trading standards, and also to pass to Merseyside Police, as taking money from people under the circumstances I believe are true (e.g, saying the money paid to him is to build a viv but not actually doing this) is deception by goods and a criminal matter. I will let the Police investigate this however.

To sum up, Andy Plumpton was paid, in full, to build a viv. He has not provided a picture of this viv, despite being asked several times for this, he has not provided copies/pictures of any delivery notes, despite saying he had them, also these were requested several times. There is no evidence whatsoever to back up his claims that he has attempted to deliver it based on phone calls from both myself and my wife to TNT. He has created several accounts on RFUK and each and every one has been banned. If he is a reputable trader, why so many accounts, and why have they all been banned?

Also, as a side note, does anyone recognise these vivs?

These pictures were sent to my wife when she asked for a picture of her viv. When she brought up the issue the top pic was not what she ordered (it should have been a double stack based on one 4ft and another 2ft) he said he had sent the wrong one by mistake, however, no other pictures ever materialised.

Thanks to anyone that can help with this. I hope it comes to an amicable solution and he just gives her her money back tonight as, at the minute, I'd like to concentrate my paternity leave time on my wife and new baby when it comes, and not court proceedings.

Thanks to those who've been in touch. It seems we're not the only one who he owes money to. No sign of my wifes £70 so far. I'll be launching court proceedings in the morning if it's not arrived as to me, it's a matter of principle now so I'm willing to take it as far as possible.

lucky i've just read all this few days ago was talking to him he gave me a price and i said its good price but haven got the money so he said i can pay weekly lucky i've just lost £10 and not £200

If you paid by paypal start a dispute you should try Volly on the site he has good prices and is very well trusted on here

She paid by direct bank transfer. But that aside, I am studied in law so going through the courts is actually an easier solution for me anyway (paypal disputes take an age whereas pursual through courts is remarkably quick nowadays!) I've compiled as much evidence as I need to in order to present a case (thankfully all communication was done through text and email which she kept) and I've had several messages from people on here to whom he also owes money.

Well, Andy didn't come forward with the money so I've just initiated court proceedings. I'm also suing him for all costs, and I'm additionally claiming compensation for distress caused. He has had the cheek to send her a text saying the amount he now owes her is only £30, despite the fact £20 was given him on top of the original price to pay for TNT, who were never booked! I am livid. He has also said there is no proof we ever sent the money to him, which, again sadly for him, is totally untrue as it was a bank transfer into a bank account owned by him. Oh, and I have an email from him saying he has the money! How he thinks there's no proof is totally beyond me.

I am not the only person who has had dealings with this guy either. He owes viv builders money for vivs they have built for him, and he owes money to the guy who built his website, and that is just the beginning. I'm saving the rest for the Police!

We have established Andy is BCI, and by a curious quirk of fate, this message appeared three days after he was paid to BUILD a viv, not supply one, build one. Vivs urgently wanted

Notice he says 'urgently wanted.' He was clearly starting to panic by this point as he had my wifes money, and nothing to give her!

Court order has just been accepted and has gone through. I forgot I can also charge him 8% daily interest for each day he doesn't pay the money back so it's all win win for me. I'm also happy to pay the additional fee for bailiffs to go and recover goods to the value of the amount owed if it comes to that. If anybody else is owed money by this guy please get in touch as I am trying to compile as large a case as I can for the Police.

It's a shame he didn't just give me wife her £70 back as all this could have been avoided!
