Default hermanns with no paperwork?

Seen an advert online with someone selling 2 hermans with no paperwork? would this not be breaking a law or something? Sorry dont keep tortoises but thought id ask you guys so I could let him know!

Yep, it is breaking the law. Was it in dundee? I texted them, and they said they were going to try and get the paperwork.

your a shifty one, i think its j00!

but yeah as snailG said, it is illegal. However, i have seen some people "giving" the required cert torts as gifts and then they get a "Donation" from the reciever.....however i think in the eyes of the law, this would still be illegal as theyre been a transaction including an amount.

Ah, I seen an ad a couple weeks ago for 2 females at a bargain price. When I found out there were no papers, i told them it was illegal, all they can do is give them away. I told them they can try and get papers from previous owner, or if they have proof of ownership in some other way, they may get them from DEFRA (I think). Told them I'd be really interested in buying if they got papers, or if they didn't but really needed them gone I might be able to help, but haven't heard back.

They probably got someone to buy them who had no idea

It depends on the amount, and whether they're selling with setup. They can say the money is for the setup and the torts are free. Can't argue with that.

ilegal it maybe but I don't think anyones ever been prosecuted or had their torts taken away, at the worst it passes on the problem of getting paperwork to the new owner. My advice is if you are getting a tort that hasn't a cert make sure you get a letter explaining why from the previous owner, even if the tort if given to you, a letter stating that it was given can make a lot of difference if you ever need to explain things. There are still a lot of owners who genuinly didn't know they needed a cert for their torts, my Sid was rehomed to me as an adult but he only had a out of date hatchling cert from 15 years ago however with a letter from his owner and this old cert I was able to get his up to date paperwork, a letter passing ownership can also be a godsend if theres ever any ownership problems.
