the thing is, if you didnt name the shop.. but said it was the only one in the area, then they would all go to him..cant have it both ways, if you;'re s**t then you're s**t

It beggars belief when numpty's that know nothing about reps can sell them in a shop but decent private breeders cannot sell their stock at a fair.

But if anyone wanted to know what the shop was a quick PM to Damo then they will have the shops name

I wish people would get over this..

legal action can only be taken if what is said/written is considered slander or libel.

Basically only if it's lies can they take legal action, generally people cannot take legal action to stop someone saying/writing something if it's true.

Neither an individual nor the forums could get any comeback if someone said "xxxxxx shop is bad here are pictures to show why" the shop could only take action if they felt and could prove everything said was untrue or an unfair attack.

Mason, in theory your statement is correct.

Its only Liable if the statements made are UNTRUE, but people opinions and feelings all come under this 'untrue' category. However, if someone states something that happened, what they saw with their own eyes (ie went to a shop, saw 20 royals all in a small viv) and the information they saw is TRUE then RFUK cannot (in theory) be done for publishing liable statements.

The trouble is people dont write their 'naming bad shop' threads in the correct way, often give thier own feelings and opinions on the matter and even if they are just stating facts... how the do we, the mods, know whats fact or not without visiting the shop or being there ourselves. I really dont need to be going to court fighting legal battles even if we are not in the wrong, which could potentially happen either way.

Mason, if you read the post made by damo you will see it is based upon HIS opinion and not on facts. I have highlighted parts of his posts that are, potentialy at least, Liable. This basicly means RFUK is publishing untrue and damaging information regarding a business if we allowed the shop to be named. (remember im talking about in the eyes of the law)
