Default Question - do you keep Hermann's, Greek/Spur-Thighed or Marginated Tortoises?

I'm wondering how many people on here keep them - and how many people could prove that their animals were captive bred or legally WC outside the EU if needed.

The following chelonian species are listed on the European Protected Species Act:

Testudo graeca (Mediterranean Spur-Thighed and Greek Tortoise)
Testudo hermanni (Hermann’s Tortoise)
Testudo marginata (Marginated Tortoise)
Emys orbicularis (European Pond Turtle)
Mauremys caspica (Caspian Turtle)
Mauremys leprosa (Mediterranean Turtle)
Caretta caretta (Loggerhead Sea Turtle)
Chelonia mydas (Green Sea Turtle)
Lepidochelys kempii (Kemp’s Ridley Sea Turtle)
Eretmochelys imbricata (Hawksbill Sea Turtle)
Dermochelys coriacea (Leatherback Sea Turtle)

There's some new legislation regarding them that took effect on the 21st of August 2007. In addition, some of the more disturbing implications are that Article 10 paperwork issued for these species may not be valid IF you cannot obtain an EPS license for them as well....

If you could answer the poll and select the appropriate species you keep I'd appreciate it - or post a list of what you do keep, and whether you've tried to apply for an EPS license yet?

Surely the Article 10 paperwork is perfectly valid considering it explicitly states that they are CB?

According to this, Athravan, it might not be enough:

http://www.defra.gov.uk/wildlife-cou...abitat-reg.pdf

Specifically:

Quote:
Government policy is that where a licence cannot be issued under one regime, it should not be issued under another: in other words, if it is not possible to issue a licence under the Habitats Regulations, applications under CITES controls should be refused.
If the Article 10 paperwork is only EVER issued for CB specimens, then that might well be enough - but the implication of the document I've linked is that Article 10s can also be issued for WC animals?

What is an EPS licence?

I have Hermann's, one from a pet shop and it says Slovenia on his paperwork, the others are from a breeder in the UK, and most definitely UK bred

I've written a couple of articles on the EPS legislation and licensing - you can find these in the "General Herp Chat" forum, under "Hobby Issues and Information".

Does your Slovenian tortoise's paperwork state explicitly that it is captive bred?

And Blondesarah: Do you have any paperwork at all on the two rehomed tortoises? It seems like most of you are very lucky and have some form of official documentation on your animals, which might make the whole EPS situation easier for you - but I'm particularly interested in people who have animals without any form of paperwork or proof of original source at all.
