He does open the eye but only fully or it's closed

I think I'm worrying about nothing maybe he just sleeps with one eye open till he doses off,
When he's out the tank both open fully and they look exactly the same,

It doesn't really sound like there's anything wrong (although a picture would help, we like pictures ). Leos are prey animals which means they can be very wary and skittish, keeping an eye open is just them checking their surroundings. Also their eyes can be very sensitive to light (especially albinos) so it may be that the light is a bit too bright.
If they look the same and you can't see any foreign object in the eye then I wouldn't worry

I only have a infrared bulb on low (dimmer stat) and the curtains open

Couldn't get a pic last night as he was shedding, never saw him do it before I was amazed!
